Court ruling in asbestos case has far-reaching impact on OSHA protection in the workplace
June 14th, 2010 - A court case that revolves around the safety of workers exposed to asbestos has strengthened the U.S. Occupational Safety and Health Administration's (OSHA) authority in citing employers for failing to protect their employees from workplace hazards.
According to a story on AFL-CIO.org, the case involved 11 immigrant workers hired by a Texas contractor to work on an asbestos removal project. They were not trained to work with the hazardous material or provided with respirators to protect them from inhaling asbestos fibers that become airborne. Exposure to asbestos has been associated with diseases such as lung cancer, malignant mesothelioma and asbestosis.
The U.S. Court of Appeals for the District of Columbia Circuit recently decided OSHA was correct in citing Houston contractor Eric Ho for 11 separate violations to cover each worker. Previously, the Occupational Safety and Health Review Commission had determined that Ho could only be cited with one violation to cover the incident.
The case has far-reaching financial impact on employers to protect each worker with proper safety training and protection since one fine to cover numerous workers may be less than the cost of properly training and outfitting the employees in protective gear.
